"Luck Line" is the studio name/brand for the games of Sheldon Benoit
"Floppy Flamingo" is a product of Luck Line
"our games" means any title developed and released by Cannibal Cod (Sheldon Benoit)
"our site" means the URL at weebly.cannibalcod.com. This url may be altered at a later date, at which points these terms of service will be updated accordingly.
"our services" means our games and our site, and any services we provide related to their use.
"We", "our" or "us": means Luck Line (Sheldon Benoit)
"You" means the actual or potential user of the site and all of our current or future games
"Intellectual Property" means all registered and unregistered (whether capable of registration or not) IPRs),including, but not limited to, patents and trade marks, designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement)
"original materials" means all intellectual property appearing in our games or on our website, with the exception of media used through public domain or the creative commons attribution license (https://creativecommons.org/licenses/by/3.0/), which will be indicated in the credits for the game in which they are used.
Luck Line is the owner of all intellectual property rights (IPR) for all original materials appearing in our games and on our site

Your use of the Site and/or our games (which includes viewing or accessing them in any way) signifies your acceptance of these Terms and Conditions detailed below and constitutes a legally binding acceptance of this agreement. Any claim or dispute between you and Luck Line that arises in whole or in part from your use of the Service shall be decided exclusively by a court of competent jurisdiction located in Canada, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in Canada.

Intellectual Property/Ownership:

All original materials that are part of our games are protected by law from unauthorized use. These are copyrighted under the copyright laws of Canada and/or similar laws of other jurisdictions.
You agree that no original materials may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, or otherwise exploited without Luck Line 's express prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the Site. All other uses of copyrighted material, including any derivative use, require express prior written permission from Luck Line. Any reproduction or redistribution of materials not in accordance with these Terms is expressly prohibited and may result in severe civil and criminal penalties.
Luck Line remain the owners of right, title, and interest, including copyrights and other intellectual property rights, in and to all original materials in our services. You acknowledge that you do not acquire any ownership rights by using or accessing our services, or any derivative works thereof.

License to Play:

Subject to compliance with these Terms, Luck Line is granting you a non-exclusive, non-transferable, revocable limited license to access our services for your own non-commercial entertainment purposes only. You agree not to use our services for any other purpose. If you violate any of these Terms, we reserve the right to terminate your license without notice.

User Content:

Any content that you upload to our services will be considered non-confidential and non-proprietary. You agree to transfer all ownership rights in any content you upload to us so that we can use, store, copy, distribute and make it available to users of our services. We reserve the right to remove any content that you upload to our services, without notice to you, if we believe that it is not in accordance with these Terms and Conditions our User Rules and therefore unacceptable for display on our services

User Rules:

Luck Line may provide communication channels such as forums, communities, or chat areas ("Communication Channels") designed to enable you to communicate with other Service users, as well as means for users to upload user created content to our services. Luck Line has no obligation to monitor these communication channels but it may do so and reserves the right to review materials posted to the Communication Channels and to remove any materials, at any time, with or without notice for any reason, at its sole discretion. Luck Line may also terminate or suspend your access to any Communication Channels at any time, without notice, for any reason. You acknowledge that chats, postings, or materials posted by users on the Communication Channels are neither endorsed nor controlled by Cannibal Cod, and these communications should not be considered reviewed or approved by us. Luck Line will not under any circumstance be liable for any activity within Communication Channels.
You agree that all your communications with the Communication Channels are public, and thus you have no expectation of privacy regarding your use of the Communication Channels. Company is not responsible for information that you choose to share on the Communication Channels, or for the actions of other users.
You agree that your use of our services shall be lawful and that you will comply with the usage rules. In furtherance of the foregoing, and as an example and not as a limitation, you agree not to use our services in order to:

post, upload, transmit or otherwise disseminate information or user content that is obscene, indecent, vulgar, pornographic, sexual or otherwise objectionable
defame, libel, ridicule, mock, stalk, threaten, harass, intimidate or abuse anyone, hatefully, racially, ethnically or, in a reasonable person's view, otherwise offensive or objectionable
Advertise or sell any products, services or otherwise (whether or not for profit), or solicit others for commercial purposes of any kind;

violate the contractual, personal, intellectual property or other rights of any party including using, uploading, transmitting, distributing, or otherwise making available any information made available through our services in any manner that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity)
attempt to obtain passwords or other private information from other members
improperly use support channels or complaint buttons to make false reports to Luck Line
exploit, distribute or publicly inform other members of any game error, miscue or bug which gives an unintended advantage
violate any applicable laws or regulations, or promote or encourage any illegal activity including, but not limited to, hacking, cracking or distribution of counterfeit software, or cheats or hacks for our services

If you click on any advertising appearing in our services, you will be dealing with external companies responsible for that advertising. We do not control the actions of these companies or the content of their websites, nor do we accept responsibility for any third party advertisements that may appear in our services. We will not be liable for any loss, damage or upset which you suffer as a result of viewing or clicking on advertisements in any circumstance. Any claim for loss should be directed against the external company responsible for the advertisement.Please report any advert that you find offensive or inappropriate to [email protected]. If we find that such advertisement breaches our advertising standards, then we will take appropriate action.

We will not be liable for any loss, damage or upset that you suffer as a consequence of our services becoming temporarily or permanently unavailable.
